If you are reading this webpage, it is likely because you are faced with the unfortunate prospect of a COVID-19 vaccine mandate from your employer. This is a very serious matter as it could likely jeopardize your employment and your ability to provide for yourself and your family. Currently, there are two legally recognized exceptions from mandatory vaccines for employees: (1) Medical Exemption (disability-related reasons) and (2) Religious Exemption (sincerely held religious beliefs). We are not a medical assessment organization. Therefore, we only address the second legal exception—Religious Exemption. At the federal level, the First Amendment and Title VII of the Civil Rights Act mandates that employers must not discriminate on the basis of religion and must make reasonable accommodations for an employee's religious beliefs, as long as the accommodation does not impose an undue hardship on the employer. WAIVER
In consideration of the COVID-19 vaccine attestation Religious Exemption letter, I, for myself, my spouse, and children, do hereby release, waive, discharge, and covenant not to sue Dr. D.C. Thomas, “Dr. Nos,” Nos Coaching & Consulting LLC, Rainbow Community Praise Center International, it’s trustees, directors, officers, employees and/or agents from liability from any and all claims including exemption from taking the COVID-19 vaccine, resulting in personal injury, or illnesses (including death), loss of employment or property.
ASSUMPTION OF RISK
Refusing the COVID-19 vaccine may carry certain inherent risks that cannot be eliminated regardless of the care taken to avoid infection. I have read the previous paragraphs and I know and understand and appreciate that these and other risks are inherent in our vaccine exemption. My exemption and that of my family is at my request and is voluntary, and I knowingly assume all such risks.
INDEMNIFICATION
I also agree to indemnify and hold harmless Dr. D.C. Thomas, “Dr. Nos,” Nos Coaching & Consulting, LLC, Rainbow Community Praise Center International, it’s trustees, directors, officers, employees and/or agents from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of this use of premises.
SEVERABILITY
The undersigned further expressly agrees that the forgoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by federal and applicable state law and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
GUARANTEE
The undersigned also understands that the COVID-19 vaccine Religious Exemption Attestation letter makes no promise and/or offers no guarantee concerning the outcome of the Religious Exemption Request.
ACKNOWLEDGEMENT
I have read this waiver of liability, assumption of risk, and indemnity agreement, and fully understand its terms. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
